Usage Policies

By subscribing to I.V. Net Illinois internet service provider, you accept the following terms and conditions. Use of the service means you have understood, accept, and agree to be bound by them.

LIABILITY, INTERRUPTIONS, OR ERRORS IN SERVICE:

  1. I.V. Net provides Internet service in Illinois in many different fashions. I.V. Net is not responsible for problems with individual computers that cannot connect to or access the internet.

  2. I.V. Net makes no warranties or representations as to the availability, content, quality, or accuracy of the services, products, or information found on the Internet.

  3. I.V. Net shall not be held liable due to loss or damage resulting from interruptions of service, delays, computer viruses, spyware, incomplete or inaccurate delivery, uploading or downloading of files or information, and the failure to deliver or deletion of e‑mail or other communications. Any liability on the part of I.V. Net, if any, shall be limited to the monthly fee paid to I.V. Net for such services.

  4. I.V. Net Server Maintenance
    Emergency maintenance will be 24 hours or less notice All other maintenance will be scheduled and all customers will be given a 1-week notice

EXEMPTION OF I.V.NET AGAINST DAMAGE FOR UNLAWFUL USE:

  1. Subscribers agree to not use the service provided by I.V. Net in any manner in violation of local, state, and federal laws and that I.V. Net shall not be held responsible for any violation, damages, losses, legal fees, etc. perpetuated by such actions. Such individuals will be responsible for any and all legal fees, damages, or losses incurred by I.V. Net in any legal action brought about by a third party.

  2. I.V. Net is not responsible for any libel, defamation, or slander as a result of the postings of a subscriber. Such individuals will be responsible for any and all legal fees, damages, losses incurred by I.V. Net in any legal action from a third party. Such posting is strongly discouraged and any user caught or proved precipitating such acts will be removed from the system upon a review of the evidence of the offending material.

  3. All postings to and through I.V. Net are not to violate Local, State, and/or Federal laws or decency standards (re: pornographic, obscene, or subversive material, etc). I.V. Net reserves the right to remove such postings at our discretion. Such individuals found posting such material will be responsible for any and all legal fees, damages resulting from said posting. I.V. Net will not be held liable in any manner resulting from subscribers posting, uploading or downloading, or making available for downloading, any obscene, profane, sexually explicit, or otherwise illegal material.

  4. Copyrighted or proprietary material will not be copied, modified, or re‑transmitted without the express permission of the person or persons holding the copyright. Subscribers agree that I.V. Net will not be held liable for any violations of the copyright laws by our subscribers, such as transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

PRIVACY:

  1. I.V. Net reserves the right to monitor (but has no obligation as of such), copy, and resend any and all material deemed necessary to fulfill the proper operation of the system or if required to do so in order to fulfill the requirements of any laws or requests of legal agencies.

BILLING PROCEDURES:

  1. The customer understands that if service is terminated for any reason prior to the expiration of the term (be it monthly or annually), any advance payments are non-refundable.

  2. I.V. Net will withdraw funds, under the authorization of the subscriber, from the subscriber’s credit card or bank account on or about the first of each month. All fund transfers from either credit card or checking account will be considered as payments made by cash or check.

  3. All accounts are due monthly or annually in advance. Billing (except for credit card or bank debits), is sent out on or about the first of each month by U.S. Mail and is due by the stated due date. If a user does not receive the bill shortly after the 1st of the month it is that subscriber's responsibility to contact I.V. Net and inform them of that fact. The subscriber will be told of any amount due. A subscriber's bill is still considered due and payable in the normal time frame. I.V. Net is not responsible for the U.S. Mail Service.

  4. Billing for the use of the service shall be continued at the chosen Plan of the subscriber until such time as the subscriber changes the Plan or cancels the service.

  5. Returned checks, rejected bank debits, or rejected credit cards, will be charged a $35 service fee. If authorization of funds withdrawal or the issuing credit card is canceled or the subscriber's account is excessively past due, I.V. Net will immediately terminate the subscriber's account access. All outstanding balances on any account will be charged an interest rate of 1.5% per month (18% annually). The subscriber is still liable for any and all charges incurred till the time of disconnection and any collection/legal fee incurred in the collection of the debt.

  6. Advance payment is non-refundable and non-transferable.

  7. Plans can only be changed before the first day of the payment due date. There will be no exceptions.

  8. Additional email addresses (user ID) may be purchased for an additional monthly charge. Some restrictions apply as listed below.

OTHER RULES AND RESTRICTIONS:

  1. I.V.Net has the right to cancel the account of any subscriber whose use of the system interferes with the use of other subscribers or threatens the stability or integrity of the services and/or products provided by I.V. Net or violate any local, state or federal laws. I.V. Net will use rules such as those below to determine the cancellation of a subscriber’s account. I.V. Net reserves the right to amend or modify these rules as seen fit.

  2. Any attempt to hack or violate our system integrity or another user’s file area is prohibited.

  3. Mass mailings, flaming, spamming, mail bombing, using bots will not be tolerated.

  4. Malicious pinging, unverifiable return headers, etc. or any attempt to flood the system or impede the use or function of the system will not be tolerated.

  5. Sharing of password or account information to any other persons is forbidden. The subscriber is responsible for all actions stemming from the account unless it is proved that unauthorized intrusion resulted in such actions. Also, additional user IDs are not transferable and are to be used only in the household of the master account holder. Violations may result in disconnection.

  6. Running any server over any I.V.Net residential Internet service is strictly prohibited. A server is defined as a computer system(s) with files open to public access, usually through an Internet transport protocol such as HTTP, FTP, POP, SMTP, or any third-party clients such as Hotline.

  7. Publishing of profane or pornographic words or images on Web pages in user areas provided is prohibited. I.V. Net reserves the right to remove such postings at our discretion.

  8. If the subscriber’s rate plan grants the use of FTP space, only the master ID (i.e. the original ID) may be used for storage or hosting. Any data found in the additional accounts will be deleted without notice.

By using IVNet service I (we) have read and understand the above information and agree to the terms above.
